Limitation of Liability

Visual Impact Promotions shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Visual Impact Promotions has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. When placing an order with Visual Impact Promotions, the customer agrees to the terms or our limited liability, and return and refund policies. Visual Impact Promotion’s limit of liability is the purchase price of the product purchased. The customer agrees to hold Visual Impact Promotions harmless for any other costs other than those associated with the direct purchase price of the products purchased. Visual Impact Promotions does not refund shipping charges. Customers are responsible for all shipping charges of products. Visual Impact Promotions is not responsible for products damaged in shipping, mis or redirected products, or any other circumstances out of Visual Impact Promotion’s control. A product may be either refunded or repaired at Visual Impact Promotion’s discretion, if it is within the return policy time frame.

In no event shall Visual Impact Promotion’s liability to Customer's for any claims under this Agreement exceed the amount paid by Customer to Visual Impact Promotion during the three (3) months preceding the occurrence of the event's giving rise to Customer's claim.

When it comes to shipping delays we follow UPS rules and Exclusions. We are unable to refund any delays due to the following below: Shipments that are delayed due to causes beyond UPS’s control including, but not limited to: the unavailability or refusal of a person to accept Delivery of the Shipment, acts of God, natural disasters, war risks, acts of terrorism, acts of public authorities acting with actual or apparent authority, acts or omissions of customs or similar authorities, authority of law, insufficient information provided by a customer, Hazardous Materials Packages improperly offered for transport, the application of security regulations imposed by the government, or other-wise applicable to the Shipment, riots, strikes or other labor disputes, civil unrest, disruptions in national or local air or ground transportation networks (including, but not limited to, UPS’s transportation network), disruption or failure of communication and information systems, and adverse weather conditions.
– International Shipments for which the customer is responsible as the payer of any applicable duties and taxes and Delivery is delayed until payment arrangements are made. Visual Impact Promotions is not responsible for any taxes nor broker fees imposed by the Canadian government or any other foreign Entity for the Drop ship of our products. Visual Impact Promotions is not responsible for any shipping delays caused by the government agency. It is the receivers responsibility to pay all duty/ taxes and broker fees associated with the shipment to the country of destination.
